Chris Brown Escapes Immediate Jail Despite Bottle Attack On Music Producer

American R&B singer Chris Brown has escaped immediate imprisonment after a London court handed him an eight-month prison sentence, suspended for 12 months, for his role in a violent nightclub attack on music producer Abe Diaw in 2023.

The sentence followed a guilty plea to affray by Brown, 37, whose repeated use of a tequila bottle to strike Diaw, including twice on the head, was described by the sentencing judge as “plainly dangerous”.

Brown’s co-defendant, Omololu Akinlolu, 40, also pleaded guilty to affray and received a four-month prison sentence, suspended for 12 months. Both men were ordered to pay £1,500 each towards the prosecution’s costs.

Delivering his ruling at Southwark Crown Court on Monday, Judge Tony Baumgartner said the attack was brief but involved intense violence in a crowded and confined nightclub environment.

According to the judge, the incident occurred in the VIP section of Tape nightclub in the early hours of February 19, 2023, when Brown approached Diaw and struck him repeatedly with a glass tequila bottle.

The judge said the weapon was used four times, with two blows landing on Diaw’s head. Brown also struck him on the shoulder and attempted another blow.

Baumgartner warned that the repeated use of the bottle created a risk of injuries significantly more serious than those ultimately sustained by the victim.

Court proceedings revealed that Diaw required hospital treatment after the incident, suffering head trauma, tenderness around the cervical spine and abdomen, as well as reduced movement in his left knee.

The court also viewed closed-circuit television footage showing the attack and the defendants’ subsequent actions. The judge said both men pursued Diaw as he attempted to move away, while a kick was directed at him when he was on the ground.

Although Akinlolu did not initiate the violence or use a bottle, the judge said he became an active participant and played a significant role in the assault. His involvement, however, was considered less serious than Brown’s, who initiated the physical confrontation.

In determining Brown’s sentence, the court considered his two previous convictions involving violence, recorded in 2009 and 2013, although the judge noted that they were old.

His compliance with bail conditions over an extended period, stable employment, charitable activities and responsibilities as a father of four were also considered.

However, Baumgartner stressed that Brown’s fame, commercial success and professional standing did not entitle him to special treatment.

The judge said the custodial threshold had been crossed for both defendants but explained that the applicable provisions of the Sentencing Act 2026 required short prison sentences of 12 months or less to be suspended unless specified exceptions applied.

He found no circumstances in the case sufficient to justify immediate imprisonment, while warning both men that a suspended sentence remained a custodial punishment.

Under the orders, the defendants will avoid prison provided they comply with the law during the 12-month suspension period. A further conviction during that period could result in the suspended terms being activated, subject to the applicable legal process.

Brown’s defence lawyer, Sallie Bennett-Jenkins KC, described the incident as ugly and regrettable, offering an apology on behalf of the singer to those present at the nightclub.

The defence also argued that the incident lasted between 17 and 20 seconds and did not result in fractures or broken skin.

Brown had initially faced more serious charges, including assault, attempted grievous bodily harm and possession of an offensive weapon, but those charges were dropped after he and Akinlolu admitted affray in July 2026.

The sentencing attracted attention outside the court, where cheering fans gathered as Brown emerged following the hearing. The singer, wearing a baseball cap, sunglasses and a face covering, signed an autograph before security personnel escorted him to a waiting vehicle.

The Metropolitan Police subsequently released annotated CCTV footage of the 2023 incident, providing a visual account of the violence considered by the court during sentencing.
