Hollywood actress Halle Berry has been placed under a temporary restraining order following allegations by her former husband, Olivier Martinez, that she physically abused their 12-year-old son, Maceo.
A Los Angeles County judge granted the order on Thursday, October 1, temporarily changing Berry’s visitation arrangements with her son. A further hearing has been scheduled for October 16.
According to court documents reported by The Independent and obtained by PEOPLE, Martinez accused Berry of physically attacking Maceo during an incident on September 26. He alleged that she put her hands around the boy’s neck and choked him, while also claiming that there had been other incidents of physical, verbal and emotional abuse over the past several years. The allegations have not been established as facts by the court.
Berry, through her lawyer Marina Beck, rejected the claims, describing Martinez’s filing as “entirely meritless and deliberately misleading”. Her lawyer said Berry remained focused on what she considered to be her son’s best interests.
The temporary order allows Berry to continue seeing Maceo but limits her visitation to Mondays and Tuesdays from 10am to 8pm, as well as Saturdays and Sundays during the same hours. The judge also declined Martinez’s request for Berry’s sobriety to be monitored, citing insufficient information.
Berry and Martinez, who married in 2013 and separated two years later, finalised their divorce in 2023 after a prolonged custody dispute. Their existing arrangement provided for joint legal and physical custody, with Berry agreeing to pay $8,000 monthly in child support.
Martinez’s lawyer, Patrick Baghdaserians, said his client’s priority was the “health, welfare and the safety” of their son. The former couple are due back in court on October 16 as the dispute over the temporary order continues.
